The purchase of an original painting, fine art print, commissioned artwork, or any other product does not transfer copyright or reproduction rights to the purchaser.
Without prior written permission, you may not:
- Reproduce or copy any artwork
- Print or distribute artwork
- Sell or licence reproductions
- Create digital or physical copies
- Mint or use any artwork as an NFT
- Use artwork for commercial purposes
Collectors are welcome to share photographs of purchased artwork on personal social media while crediting Tabassum Malani where appropriate.
Product Information
Every effort is made to accurately display colours, textures, and product details.
Please note that colours may vary slightly between screens due to monitor and device settings.
We encourage customers to carefully review product descriptions, dimensions, and specifications before placing an order.
Orders
All orders are subject to availability and acceptance.
We reserve the right to refuse or cancel an order where necessary, including pricing errors, suspected fraud, or stock availability.
If your order is cancelled after payment, a full refund will be issued.
Original Paintings
Every original painting is unique.
Small variations in colour, texture, and finish are part of the handmade nature of original artwork and should not be considered defects.
Original artworks include a Certificate of Authenticity where stated.
Fine Art Prints
Our fine art prints are produced using premium archival materials.
Because prints are delicate products, they should be handled carefully immediately after opening.
Art Classes & Workshops
Bookings for classes and workshops are subject to availability.
Specific cancellation or rescheduling terms may apply and will be provided at the time of booking.
Returns & Refunds
We want you to be completely satisfied with your purchase.
Eligible products may be returned within 14 days of delivery, provided they are unused, undamaged, and returned in their original packaging.
Fine Art Prints
Returns are accepted only if the print is returned in its original condition and packaging.
Returned prints that show signs of handling, damage, or wear may not qualify for a refund.
Original Paintings
Due to the unique nature of original artwork, all original painting sales are considered final.
If your original artwork arrives damaged during transit, please contact us within 24 hours of delivery with clear photographs of both the artwork and packaging. We will work with you to provide an appropriate solution, including repair, replacement where possible, or another suitable resolution.
Damaged or Faulty Items
If you receive a damaged or faulty item, please notify us as soon as possible.
Include:
- Your order number
- Photographs of the damage
- Photographs of the packaging
We will assess the issue promptly and arrange an appropriate solution in accordance with Australian Consumer Law.
Customer Responsibility
Once products have been successfully delivered, customers are responsible for their safe handling and storage.
Damage resulting from misuse, accidental damage, improper handling, moisture, direct sunlight, or general wear is not covered under our returns policy.
International Orders
Orders shipped outside Australia may be subject to import duties, taxes, customs fees, or other government charges imposed by the destination country.
These charges are the responsibility of the customer and are not included in the purchase price or shipping costs.
If an international shipment is refused because customs charges are not paid, any refund will exclude the original shipping costs and any return shipping or customs charges incurred.
All shipments are declared at their actual purchase value. We cannot alter or falsify customs documentation.
Limitation of Liability
To the maximum extent permitted by law, Tabassum Malani Pty Ltd shall not be liable for indirect, incidental, special, or consequential damages arising from the use of this website or the purchase of our products.
Nothing in these Terms excludes or limits any rights available to consumers under the Australian Consumer Law.
